C&R HOME IDEAS.  TERMS & CONDITIONS

 

1. Definitions

          ACL means Australian Consumer Law

          Agreement means these Terms and Conditions of purchase..

          Company/Seller means C&R HOME IDEAS ABN 81 203 274 656, its successors and assignees or any person acting on behalf of and with the                 authority of C&R HOME IDEAS ABN 81 203 274 656.

          Customer/Client means the person/s engaging the services as specified in any Agreement, Invoice, Purchase Order or Quotation, and if                       there is more than one

             Customer is a reference to each Customer jointly and severally. This includes the executors, administrators, successors and permitted                         assignees of that person or company;

          Goods means all Goods or Services supplied by the Company to the Customer at the Customer’s request from time to time in accordance                   with this Agreement (where the context so permits the terms ‘Goods’ or ‘Services’ shall be interchangeable for the other);

          Installation means the installation of the Goods at the delivery site requested by the Client;

             Price means the Price payable for the Goods as agreed between the Seller and the Customer.

          Purchase Order means any order or request made by the Client for the supply by the Seller of Goods and/or services in any form and                         includes an oral request for the supply of goods, or an invoice, proposal or quote provided by the Seller at the Client’s request;

          Service means all services supplied by the Seller to the Customer in relation to the goods.

 

           1.0  Goods come with warranties that cannot be excluded under the Australian Consumer Law.

           You, the Customer, are entitled to a replacement or refund for a major failure, and for compensation for any other reasonable foreseeable loss             or damage.

           You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a               major failure.

           

           1.1  C&R Home Ideas warrants to the original purchaser of the C&R Home Ideas Product that the C&R Home Ideas Product purchased will be                      free from defects in materials supplied by C&R Home Ideas under conditions of normal use for the applicable warranty period set out in the                 table below.

           1.2   The warranty period commences from the date of installation. This warranty is not transferrable.

 

           1.3.  Subject to the Australian Consumer Law, this warranty excludes any accessory products that are fitted to the C&R Home Ideas Products,               including (without limitation) any locks, handles, rollers, hinges and door closers, unless set out in the table above for the relevant C&R Home               Ideas products These accessory products, where applicable, may be covered by warranties supplied by the relevant manufacturer or                           supplier of those accessory products.

          1.4.  The obligation under this warranty is limited to repair or replacement of the product or components found to be defective by C&R Home                  Ideas or their duly appointed representatives.

          1.5.  This warranty does not cover defects or damage caused by any act, event or matters outside of the control of C&R Home Ideas, including              (without limitation) accident, alteration of the product in any way, fire, flood, earthquake, natural disasters, abuse, malicious attack, misuse,                    wear and tear, negligence or failure to follow our instructions with respect to cleaning or maintenance.

         

         1.6.  Under this warranty, C&R Home Ideas shall not be liable or responsible for incidental or consequential damages, or for any other direct or             indirect damage, loss, cost, expense or fee.

 

         1.7.  The benefits conferred by this warranty are in addition to all other rights and remedies which the purchaser has under the law in relation to           the goods to which this warranty relates.

        1.8.  In order to prolong the life of the C&R Home Ideas product and maintain your rights under this warranty, you must follow the care and                      maintenance advice set out within the Warranty and Care Guide.

         

        2.0.  Jurisdiction

​

        2.1      These terms and conditions are to be governed by and construed in accordance with the laws of Victoria and any claim made by                                    either party against the other which in any way arises out of these terms and conditions will be heard in Victoria and you agree to                                  submit to the jurisdiction of those Courts.

        2.2     If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as                              necessary to render it valid but only to the extent necessary to achieve such validity.  If necessary, the invalid provision will be deleted                        from these terms and conditions and the remaining provisions will remain in full force and effect.

MAKING A CLAIM

 

All claims under this warranty should be made to C&R Home Ideas by contacting  C&R Home Ideas via our  website at www.crhomeideas.com or by phone (03) 9021 1483.

 

Your original Invoice or receipt of purchase will be required.

An authorised C&R Home Ideas representative may arrange an inspection of the product and you will be responsible for any repair charges whereby you are not eligible to make a claim under the terms of this warranty.
